What is Chapter 13 Bankruptcy?

Chapter 13 it is designed for people who are in a situation where they are unable to pay all their monthly bills in full each month, but still have enough income to take care of themselves and their family's necessary expenses, or have suffered a temporary loss of income due to unemployment, medical problems, or other set backs, but are now earning enough to afford their necessary monthly expenses, but are unable to afford to "catch up" on secured or priority obligations. A Chapter 13 will allow you to cure missed payments on necessary items you need (such as house and car). Under a Chapter 13, most of your unsecured debt is usually wiped out upon completion of the plan, as you only pay a portion of it based on what you can afford. A Chapter 13 will stop a pending foreclosure or repossession, and allow you to catch up missed payments through the plan over three to five years.

Chapter 13 bankruptcy differs from Chapter 7, because it is a form of debt reorganization. It obligates a person to make a monthly payment under a personalized repayment plan, the bulk of which normally goes to secured and priority creditors. Under Chapter 13, a person only pays a portion of the unsecured debt based on the ability to pay.

Chapter 13 is ideal if you:

  • Have non-exempt assets that you want to protect and/or are behind on payments for secured items you wish to and can afford to keep.
  • Hope to save a home or property from foreclosure
  • Want to prevent repossession of a vehicle (or recover it)
  • Have back taxes less than three tax years old (priority debt)
