Giving You a "Fresh Start"

Chapter 7 is often called the "fresh start" approach to bankruptcy. Chapter 7 is a form of debt relief that excuses many unsecured debts ¾ although not all ¾ without the obligation of repayment. It stops creditors from harassing you and continuing to collect money from you. It stops all collection action, including garnishments and levies (except for child support). It will also allow you to get rid of Judgments and Judgment liens, whether secured or unsecured. If a lien has been recorded against real property you own and live in, then the lien can be canceled if it impairs your homestead exemption. You can usually keep personal and real property you are still paying for if you so choose and can afford to. In order to keep secured debts, you must be contractually current on the payments, be able to stay current, and maintain any required insurance. Free and clear personal property can normally be kept, as long as the value (garage sale does not exceed the allowed exemption). Please note that many if not most assets are exempt, which means you will not lose them to your creditors or the bankruptcy Trustee. Even if something you own is over your allowed exemption in value, you can agree to pay the difference to the Trustee and still keep the item(s).

Is Chapter 7 Right for You?

One way to determine if you qualify for Chapter 7 is by taking a bankruptcy means test. If your total household income is under the median income level for the same size household in Colorado, then you technically qualify to file for Chapter 7 (assuming you meet all other mandatory requirements). If your household income is above the median income level for the same size household, then you would either need to pass a long form means test, which takes other factors into consideration, or potentially file a Chapter 13. In order to file for Chapter 7, you must be and be able to stay current and afford any secured debts you intend to keep. A Chapter 7 will get rid of most of your unsecured debts, which will hopefully allow you to be able to afford your necessary expenses. If however you are behind on secured debts you wish to keep, such as your house and car, then filing under Chapter 13 may be the better alternative.
