There are many different reasons why people file for consumer bankruptcy but the common thread is financial stress – it may be caused by credit card debt, divorce, loss of employment, medical bills, or psychological problems.

There is a big difference between filing for consumer bankruptcy under Chapter 7 as opposed to Chapter 13. Chapter 7 is a form of debt relief that eliminates many unsecured debts. Chapter 13 is a form of debt re-organization that enables you to repay all or part of your obligations based on your ability to pay, thereby allowing you to keep your financial promises.

Our Process

Our clients normally have three appointments with our bankruptcy lawyers and staff prior to filing their bankruptcy petition. The first is the free initial consultation where we briefly go over your financial situation, and answer questions about and explain the bankruptcy process. We will give you paperwork, including a list of items and documentation you will need to prepare and gather for the next appointment. We do not require you bring anything to the initial consultation, though a paystub with YTD income might be helpful. You may also bring any documents you have questions about, or are of concern to you, such as lawsuits and foreclosure notices. At the second appointment, we will review all the information and verify we have all required documentation necessary, which will allow us to formulate the actual bankruptcy, and verify eligibility. We will require the retainer and filing fee, as well as completion of the credit counseling class, prior to this appointment. Assuming we have all the information necessary, the third appointment will be to review and sign the complete case.

After the case is filed, you are required to attend a "meeting of creditors", which is approximately 30-35 days after the case was filed. The bankruptcy Trustee assigned to your case will conduct the meeting (which your creditors are NOT required to attend, and rarely do). Once the Meeting has been concluded, there is a 60 day waiting period where the creditors have the right to object to their debt being discharged (assuming they have some legal basis, such as fraud). You must also attend a Financial Management/ Debtor Education (2nd) class after the case has been filed, and obtain the 2nd certificate, which needs to be submitted to our office and will be filed with the Court by us after you have attended this meeting. You have 45 days after this meeting within which to complete the class and have the certificate filed, or it will delay the entry of your Discharge. If you fail to complete this class within the time allowed, your case will be closed without the entry of a Discharge (which is what gets rid of the debts). After the deadline for objections to Discharge (60 day period after creditor meeting) passes, the Court will usually enter the Discharge within about a week or two, assuming you have completed the 2nd class and we have filed the certificate for you.
